    My name is Elizabeth Lewallen. My age 79 years. My residence is Alcorn county, Mississippi. I am related to claimant Daniel Lewallen, but have no beneficial interest in the claim. I heard claimant frequently talk about the war and he was regarded in the neighborhood as a Union man. I did not see the mules or horse taken but I know he was the owner of the horse and mules described in the amount and the mules and horse were taken. They were all likely and in fair condition. In the year 1862 claimant had two fields of corn. I do not know how large. I saw the most of the corn taken in the fields. There was a large wagon train and I think they took at least thirty wagon loads. They were large wagons, the wagons loaded with corn went in the direction of their camps at Rienzi.     This indenture made this 11th day of May one thousand Eight hundred & thirty eight between David Lane, Burley Lane, Abraham Lane, John Lane, William Lane, Polly Killgore, Nancy Killgore, Pegy Bradford all of the County of Marion & State of Tennessee Daniel Lane, of the County of Warren & State aforesaid & Elizabeth Luallen of the County of Jackson & State of Alabama of the one part & Isaac Lane of the County of Marion & State of Tennessee of the other part WITNESSETH: that for and in consideration of the sum of one hundred a fifty dollars to us in hand paid the receipt whereof is hereby acknowledged hath bargained sold and do by these presents release enfeoff? and convey unto Isaac Lane his heirs and assigns forever a certain tract or parcel of land containing sixty acres more or less ? lying and being in the County of Marion.   • Notes 
    • Elizabeth Layne doesn’t get much mention in the Layne-Lain-Lane genealogy book. Just a single line that mentions her birth around 1794 and her marriage to Daniel Luallen of Alabama. I was not optimistic that I would learn very much more about her, but was pleasantly surprised to find a few items beyond the usual census records.

      The first was the will of her sister-in-law, Elizabeth Tipton. Elizabeth Tipton’s estate was settled around 1870 and lists the surviving children of Daniel and Elizabeth Lewallen allowing us to positively identify more than just those mentioned in the censuses from 1850 on. The heirs listed are: P (Preston) Lewallen, Madison Lewallen, Andrew J Lewallen, Daniel Lewallen, Polly (Mary Ann) Hammons, M W (Monroe Washinton) Lewallen, and M J (Martha Jane) Lipscomb. From census records we also identified sons William and James Lewallen. Other researchers claim that Daniel and Elizabeth had as many as thirteen children (Charles and Nancy being commonly mentioned) but at this time I’ve only listed the nine that I can confirm. The 1830 and 1840 census provide clues that Elizabeth did indeed have additional children and further research may be able to positively identify them.

      While the first item was valuable in identifying Elizabeth’s children, the next was an interesting window into a time and place in her life. In 1873 Elizabeth’s son Daniel filed a claim to be compensated for some of his property taken by the Union army in 1862 about 8 miles west of the town of Rienzi in Alcorn County, Mississippi. Elizabeth lived with her son Daniel from time of her husband’s death sometime before 1850. The timing and location puts Elizabeth and Daniel just south of Corinth, Mississippi during the Siege of Corinth and later the Second Battle of Corinth.

      Daniel's claim, filed with the U.S. Southern Claims Commission, stated that the Union army made off with four mules, 860 bushels of corn, and a horse over a period of time between August 1st 1862, and October 1st 1862. This would have been just before the Second Battle of Corinth which took place between October 3rd and 4th, 1862. Daniel was looking to be compensated $1,760. This claim includes depositions by several people including his mother Elizabeth in September of 1873. However it seems the commission wasn’t convinced and denied Daniel’s claim in December of 1874.

      Speaking of the Civil War, Elizabeth is the first of John’s children that I’ve discovered to be slave owner. In both the 1830 and 1840 census, there are 4 slaves recorded for the Lewallen household while Elizabeth’s husband Daniel is still living. However it seems the family was divided over the issue of slavery as Elizabeth is never found owning slaves beyond this point and her son Daniel describes himself as a Union man in his claim with the U.S. Southern Claims Commission. You might think that’s to be expected from someone with $1,760 worth of motivation in convincing the commission that was the case, but Daniel also describes how one brother fought for the Confederacy while another fought for the Union cause in his deposition. Elizabeth’s feelings on the issue of slavery are not known, but they likely mirrored Daniel’s. Whatever her feelings on slavery she could not have been pleased to find her sons facing off on opposite sides of the war.

      Elizabeth’s mention in the 1880 census (listed as E.B. living with son D.) is the last known record for her. She is listed as 90 years old but 86 is probably closer to the mark. The time and place of her death isn’t known, but odds are she probably passed away not long after 1880 in the home of her son Daniel just west of Rienzi, Mississippi.
