    This Indenture made this 7th day of August in the year of our Lord 1829 between Churchwell McNew of the County aforesaid Marion and State of Tennessee of the one part and David Lane of the County of and State aforesaid of the other part Witnesseth that for and in consideration of the sum of two hundred dollars him the said Churchwell McNew in hand paid the receipt whereof is hereby acknowledged hath bargained and sold and do by these presents acknowledged hath bargained and sold and do by these presents alien enforce sell convey unto the said David Lane a certain tract or parcel of land containing twenty three acres situated in Marion County on the north west side of Sequatchie river on Halls branch adjoining lands of Thomas Brannson; James Blevins and others. Beginning at a post oak on Branson line it being the corner of a tract conveyed to Isaac Cooper for twenty acres then along said Branson line north thirty nine poles to a stake then east thirty four poles to a chinapine Oak Blevins corner then with his line North nine West twelve poles to a white oak then east thirty poles to a stake on Edging line and with the same South twenty five poles to pointers then west twenty nine poles to a stake said Lane division and with said division a direct line to the beginning including the aforesaid twenty three acres be the same more or less it being the said Churchwell McNew will warrant and forever defend so far as the title of the same invested in me by the Grant from the State of Tennessee above specified and no further as this is the express contract.   • Notes 
    • Very little is known about David, but starting with the information found in the Layne-Lain-Lane Genealogy book by Floyd Benjamin Layne gives us a starting point though there are several issues starting first with his 1830 census citation. David is shown living in Marion County, Tennessee with 2 males < 5, 2 males 10-14, 1 male 30-39, 1 female < 5, 1 female 5-9, 1 female 10-14 and 1 female 30-39 which is much different from what is shown in the book. The Layne book helpfully makes mention of a 1858 deed of conveyance wherein David’s heirs sign a deed to his land. leading me to believe that the children the 1830 census refers to are: Stephen, William, Elizabeth, Esther, Abraham, an unknown female and one of Charles, David, or John.

      David may have passed on by the time the 1840 census rolls around as there is no record of him. Stephen, William, Elizabeth, and Esther do appear but it’s William’s entry that is noteworthy. William’s entry lists the following: 1 male < 5, 3 males 5-9, 1 male 10-14, 1 male 20-29, and 1 female 10-14. The male 20-29 is, of course, William who would have been 24 at this point. The female is the same unknown female from the 1830 census. That she does not appear on the deed in 1858 leads me to believe that she had passed on by that time. The other boys are almost certainly William’s brothers: Abraham, Charles, David, and John. That leave us with a extra brother who's name is unknown. One thing to note is that one of the people in this census is listed as "insane or idiotic" but no trace of this "insane or idiotic" individual appears in the following census.

      In 1841 several grants (#8510, #8589, #8591 jointly with brother Abraham) are awarded to David which is curious if he has indeed passed on prior to this as I expect. Perhaps it was not known for a certainty that he had died and they were awarded in absentia, Or perhaps those grants passed down to his heirs. In any case the Layne book tells us that on 13 April, 1842 David’s heirs gave power of attorney to William Lane Jr. to demand their share of the estate from on Raphael Shelton [trustee or administrator]. The book goes on to tell us that perhaps there was a disagreement in the as the estate was not finally settled until 3 March 1858. Another explanation might be that the estate could not be properly settled until all heirs had reached a certain age to legally sign away their rights to it. The deed is recorded in Marion County Deed Book “H” on pages 183 & 184:

      Washington Pryor for $1000 for 343a in District #4 Marion co Tenn on waters of Halls Creek adjoining lands of Joseph Clay and others, including land known as the Old David Lane place and the land described in grants 9790, 8510, 13345, 8591, 10777, 12508, 8589. The deed was signed by heirs of David: Stephen Lane, Abraham Lane, William Stegal & Elizabeth Stegal, William Lane, John Lane, Noah McCrary & Esther McCrary, Charles Lane and David Lane.


      Of the heirs listed in this deed, Stephen, William, Elizabeth and Esther are fairly easy to track and leave little doubt as to their identities. Stephen (b 1815) appears in each Marion County census from 1840 through 1880 married to Sina. William (b. 1816) is a little trickier appearing in the 1840 census described above as well as in 1850 and 1860 with wife Sarah. Elizabeth (b. 1819) marries William Stigall. They appear in the Marion County census in 1840, Grundy County in 1850, eventually settling in Missouri where Elizabeth will appear on each census from 1860 to 1900. Esther (b. 1820) marries Noah McCrary and they appear on each Marion County census between 1840 and 1880 with the exception of 1850 in Hamilton County.

      After these four children, things get a little trickier. Let’s take them in turn starting with the only other named child appearing in the Layne book: Abraham (b. ABT 1828). We believe Abraham is one of the four boys living with William in the 1840 census. There are three possible conflicts to be aware of when searching for Abraham after this. They are: the son of John & Esther b. 1829, the son of Daniel & Anna b. 1835, and even Stephen and Sina’s son Abraham b. 1837. When I first researched David’s children I was under the impression that Isaac & Mary also had a child named Abraham b. 1827. Since then I have decided that is incorrect and the Abraham often considered the son of Isaac & Mary is almost certainly David’s son. There is still a concern over the account that Abraham and brother William were hanged as Confederate sympathizers during the Civil War as this Abraham is possibly the same that is buried in Burkett Chapel cemetery who lived until 1907.

      The next and easiest to track heir is Charles (b. ABT 1830). There are no potential conflicts to be concerned with as far as I know with this Charles so any Charles Lane we find born around 1830 in Marion County is likely our guy. He is likely one of the children living with William in 1840 of course, but oddly we find no Charles listed in the 1850 census. In 1860 Charles appears in the Marion County census with wife Elizabeth 20, an children Mary Ann 5, William 4, and James 2. He is once again missing from the 1870 census. Another Charles is present but is much too young (and married to the wrong wife) to be the Charles we’re interested in. In 1880 Charles once again reappears living with wife Elizabeth 42 and children William 23, James 19, David 16, and Elisa J 14, and granddaughter Berta Heperson 6.

      David (b. ABT 1836) has the most like named contemporaries than any of the David Sr’s children. This includes Abraham & Rebecca’s son b. 1830, Burrell & Emily b. 1836 and John & Esther’s b. 1837. In the 1850 Marion County census only these three appear. Again in 1860 there are only three Davids present. The first is David married to Maryan who we believe to be the son of Abraham and Rebecca. The second is living with John & Esther Lane so that one is pretty easy. It might be tempting to think that David aged 24 and married to Nancy is the son of Burrell & Emily except David’s sister, Esther, is living just two households over. Despite not having located David, son of Burrell & Emily, I am very inclined to believe that is David Jr. Unfortunately this is the only census record that David and Nancy appear in.

      Of John virtually nothing is known. Only that his name appears on the deed for 343a and that he was born prior to 1840. With John being such a common name, our only hope was that he would appear alongside one of his siblings in the census records of Marion County or Missouri. That said there are only two possible conflicts with David’s John, that being the son of John & Esther b. 1831 and Daniel & Anna b. 1833. Both are accounted for in the 1850 and 1860 census records of Marion County. There are any number of candidates outside of Marion County, but so far a definitive identification has been elusive.

      Finally, there is the female whose name does not appear on the deed in 1858. She is listed as aged less than 5 in 1830, and between 10 and 14 in 1840 then nothing more, or is there? You may have noticed that Abraham, Charles, David, and John were all missing during the 1850 census. And yet most resurface in 1860 or are at least present to sign the deed of 1858. So where are they in 1850? All 5 were living with William in 1840, or perhaps it could be reasoned that the five boys were living with this unnamed female. In 1850 William is married and living with his wife and children. It seems possible that our mystery woman married sometime before 1850 and the other four boys were continuing to live with her. It’s also possible the census taker recorded their last names incorrectly which would explain why they have yet to be found in the 1850 census.

      The Layne book only lists six children for David Layne with one an unnamed son. And yet the deed for 343a lists eight and the census data from 1840 and 1850 indicates that there was a third daughter. I therefore believe that David had a total of nine children and also that the third daughter had likely passed away prior to signing the deed to the “Old David Lane place” in 1858. We’ve identified several candidates that could be the children missing from the Layne book or, like the sister whose name we may never know, they may have passed away before we could discover who they really were.
